정치, 사회 - 113

국가권력이 강요할 수 없는 가족도덕을 법률로 규정한다는 것은 넌센스다. 따라서 [부모를 섬겨야 한다], [부부는 서로 사랑해야 한다] 따위의 법률은 아무런 의미도 없다는 것은 이해할 수 있다. 그러나 민법에서 [부부는 서로 정절을 지킬 의무가 있다]고 규정했다고 해서 조금도 이상할 것이 없다고 생각한다.

 

<표현 연구>

• 국가권력 - state power, the authority of govenment.
• 강요하다 - force(impose, press) upon ~. [법률을 시행하다]의 뜻인 enforce도 같은 의미로 쓸 수 있다.
• 가족도덕 - the family morality.
• 법률로 규정하다 - [법률로 제정하다]는 make a law, lay down(enact, paa) the law 이고, 이렇게 해서 성문이 된 것을 statute 라고 한다. 이 경우에는 [법률의 조문으로 써넣다]의 뜻이므로 write (something) into law 가 된다. 이같은 법률의 조문을 계통적으로 법전화하는 것을 codify 라고 하낟. 이렇게 성립된 법률이 [... 라고 규정하고 있다]는 the law provides that ... 처럼 표현하며 [규정 조항]은 provisions 가 된다.
• 넌센스 - 관사 없이 nonsense 이다. 이것은 각각 문맥에 따라 silly ideas 나 absurd acts 의 뜻이 되므로 구별하여 써도 된다.
• 부부- 대구로서 man and wife 및 husband and wife 따위를 쓰는데 다 같이 관사가 생략된다. 여기서는 a man and his wife로 하는 편이 구체적이다.
• 민법 - the civil law; the civil code.
• 정절을 지키다 - ([정절]은 chastity, fidelity, faithfulness) show fidelity toward each other; defend their chastity 따위의 표현이 있지만, 이것보다는 remain faithful to each other 쯤이 온건한 표현일 듯.
• 의무가 있다 - (It를 주격으로 하면) it is one's duty; it is up to ([person]) to ... ; it it incumbent upon (person) to ... ; (사람을 주격으로 하면) one must ; one is bound to ... ; one is in duty bound to ... ; one is under obligation to ...
• 이상하다 - ([우습다, 우스꽝쓰럽다]의 뜻으로 보아) be ludicrous, be rendered ludicrous.

 

<구문 연구>

1. [...의미가 없다는 것을 알 수 있다]에서 [의미가 없다]까지는 누군가의 주장이다. 따라서 여기까지 우선 문장을 끓고 별도의 sentence로 This assertion (standpoint, view) I understand well, but ... 처럼 이번에는 자기의 주장을 피력하는 것이다.
2. 두 번째 문장 [... 따위의 법률은 ... ]에서 [법률]은 [법률상의 규정]을 말하는 것이므로 provision 을 쓴다. 따라서 Such provision in the law as ... are meaningless. 로 하거나 The law having such clauses as ... is quite meaningless 로 한다.
3. [.... 라고 규정했다고 해서 조금도 이상할 것이 없다]는 (a) even if the Civil Code should provide that ... , it would not be ludicrous at all. (b) the Civil Code would not be rendered ludicrous by having such a provision as ... 따위로 옮겨본다.

번역

(1) It is nonsense to write into law the family morality which the state power cannot impose upon individuals. Therefore such provisions in the law as "Parents should be taken good care of" or "a man and his wife should love eath other" are meaningless. This assertion I can agree with well, but I do not think that the Civil Code would be rendered ludicrous in the least by having such a clause as "A man and his wife should remain faithfull to each other."

(2) It is nonsense to specify in the law such family moralities which cannot be forced upon individuals by the authority of government. Thus the law having such clauses as "Parents should be taken good care of" or "Husband and wife should love eath other" is quite meaningless. This view I can understand well, but it seems to me that if the Civil Code should slate that husband and wife should remain faithful to each other, it would not be ludicrous at all [one would not find anything ludicrous in it].
